TERMS OF SERVICE – TattooVISTA by SchoolINK

1. Acceptance of Terms

By accessing or using TattooVISTA by SchoolINK ("Platform", "Service"), you agree to be legally bound by these Terms of Service. If you do not agree, you must immediately discontinue use.

2. Description of the Service

TattooVISTA is a SaaS platform that provides:

  • AI-powered tattoo simulation on images;
  • Real-time camera capture functionality;
  • Image upload from user devices;
  • Integration with third-party image sources (e.g., Pinterest);
  • Editing, visualization, and export of simulated tattoos.

The Service is intended for visual simulation purposes only.

3. Eligibility

You must be at least 18 years old or have legal guardian authorization. By using the Service, you represent and warrant that you meet these requirements.

4. User Account

  • You agree to provide accurate and complete information;
  • You are responsible for maintaining account confidentiality;
  • Accounts are personal and non-transferable;
  • We reserve the right to suspend or terminate accounts at our sole discretion.

5. Device Permissions

The Platform may request access to: Camera, Photo library/storage, and Internet connectivity. You may revoke permissions at any time through your device settings. Certain features may not function without these permissions.

6. User Responsibilities & Acceptable Use

You agree NOT to:

  • Upload or process illegal, harmful, or fraudulent content;
  • Use images of individuals without proper consent;
  • Violate intellectual property rights;
  • Upload offensive, abusive, or discriminatory content;
  • Use the Service for deceptive or misleading purposes;
  • Process sensitive personal data without legal basis.

7. Image Rights & Consent

You represent and warrant that you own or have obtained all necessary rights, licenses, and consents for any image uploaded or captured, and that any identifiable individual in the image has provided explicit consent. SchoolINK assumes no liability for misuse of image rights by users.

8. Artificial Intelligence Disclaimer

The Service uses automated AI systems. Results may be inaccurate, distorted, or non-realistic. Outputs must not be interpreted as professional or final results. We expressly disclaim any guarantee of accuracy or fitness for a specific purpose.

9. Intellectual Property

Users retain ownership of uploaded images and generated outputs. You grant SchoolINK a limited, non-exclusive, worldwide, royalty-free license to process content solely for Service operation. All rights related to Software, AI models, Algorithms, UI/UX, and Branding are the exclusive property of SchoolINK. Reverse engineering, scraping, or replication is strictly prohibited.

10. Third-Party Services

The Platform may integrate third-party services. We do not control third-party content, are not responsible for external policies, and do not guarantee legality of third-party images. Users are solely responsible for compliance with third-party terms.

11. Subscription & Billing

Subscription plans may be offered. Billing may be recurring. Fees are non-refundable unless required by law. Failure to pay may result in suspension.

12. Service Availability

We do not guarantee uninterrupted service. The Platform may be modified, suspended, or discontinued at any time without notice.

13. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE". SchoolINK disclaims all warranties, express or implied. We are NOT liable for any tattoo decisions made based on simulations, misuse of generated images, third-party claims related to image rights, or loss of data, profits, or business. Total liability is limited to the amount paid by the user in the last 12 months.

14. Indemnification

You agree to indemnify and hold harmless SchoolINK from any claims, damages, or legal actions arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

15. Data Protection & Privacy

Use of the Service is governed by our Privacy Policy. We comply with LGPD (Brazil), GDPR (EU) where applicable, and international data protection standards.

16. Termination

We may suspend or terminate access for violations of these Terms, for legal compliance, or at our sole discretion.

17. Governing Law & Jurisdiction

These Terms shall be governed by the laws of Brazil. For international users, disputes may be resolved via arbitration.

18. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
